BJP Decided to Annul Article 370 of Special Status of Jammu and Kashmir|
Bharatiya Janatha Party(BJP) decided to annul Article 370 of the special status of Jammu and Kashmir. Amit Shah announced officially in the Parliament on August 5, 2019.
What is Article 370?
Article 370 is for providing the special status to the Jammu and Kashmir. Article 370 implements certain rules and declare the Jammu and Kashmir as an Independent Indian State.History of Article 370 of the Princely States
Long ago, British left the decision to the princely states to either join into Indian Union or Pakistan Union or can stay independently.The king of the Jammu and Kashmir, Raja Hari Singh stated and declared to stay independently. Then the Pakistan "Azad Kashmir Army" tried to occupy the Kashmir on October 20, 1947, and occupied some part of Kashmir. It is known as Pakistan Occupied Kashmir (POK).
Maharaj Raja Hari Singh asked the help from India. The prime minister of India, Jawaharlal Nehru and Raja Hari Singh signed on the agreement called "Instruments Of Accession of Jammu and Kashmir to India" on October 26, 1947. As per agreement agreed to surrender three subjects like Defence, Communication, Extra Affairs.
The agreement called "Instrument of Accession Of Jammu and Kashmir to India" is nothing but the Article 370. Dr B.R Amedkar drafted this article in the Indian Constitution as per the request of Prime Minister, Jawarhal Nehru and Kashmiri leader Sheikh Abdullah. It came into force since November 17, 1952.
Article 35 (A) allows people of Princely States to be permanent citizens of the state. It was issued by the Rajendra prasad under Article 37 on the advice of Nehru-led Union government.
Rules of Article 370
- Princely states will be Independent and follow only the instructions of its own state government.
- The central government has no power or any authority on the Jammu and Kashmir.
- The Financial emergency cannot declare in the Jammu and Kashmir.
- Jammu and Kashmir have two flags. One is own flag of the Princely state. The other is the flag of India.
- Princely states have two citizenships. One is Indian Citizenship and other is Kashmiri Citizenship. Any person cannot have two citizenships simultaneously.
- The changes and fundamental laws will be different from India.
Announcement of Abolishment by Amit Shah
Now, Amit Shah, Home minister gave an Official announcement of abolishing Article 370 of special status to Jammu and Kashmir in the Parliament on 5 August 2019.
Amit Shah mentioned " Jammu and Kashmir will be reorganised and no longer will be a state. Ladakh and the Princely States will be two Union Territories. Ladakh union territory will not have any assembly or Power of Legislation. Jammu and Kashmir is a union territory with the Power of Legislation and Assembly. The two Lieutenant Governors will be appointed for the two union territories."
He announced in the Parliament after the cabinet meeting with the Prime Minister, Narendra Modi at the prime minister home. The BJP government took a massive decision after building of troops in the Valley of the Kashmir. The senior leaders and former chief ministers were house arrested.
Phone, Internet services were jammed. The educational institutions and companies were closed. The people of the Princely States are protesting strongly against the decision of the BJP. The Official Notification on Article 370 was already signed by the president of India, Ram Nath Kovind.
